INTERVIEW I Assoc.Prof. İpek Eren VURAL Spoke to Notario After the Elections

 After the elections, Assoc.Prof. İpek Eren VURAL, one of the noble members of the Election Board, spoke to Notario. After a general evaluation of the election process, Vural responded to the criticisms. 

"HIGH INTEREST IN THE ELECTION IS PLEASING"

Stating that such a high level of interest in the election was pleasing for democracy and the process, Vural congratulated all parties. Vural continued his speech by saying, "The parties made their propaganda in a civilised manner and welcomed the results with maturity." 

"CLOSED COUNTING DECISION WAS A BAIT THROWN TO THE PARTIES"

Vural responded to the question of closed counting by saying, "The closed counting decision was made deliberately in order to enable the parties to come together and object. We aimed to ensure that the parties meet on a common ground and use their right to object. However, the parties could not utilise this opportunity." She also stated that she had previously announced in his lecture that the Electoral Board could make such decisions against the parties and that the parties had the right to appeal. In this context, if there was an objection from even one party, open counting would have been possible. She stated that the parties entering the parliament could also face such decisions in the first session of the parliament and that they should be ready for these situations. 

Vural further stated that the parliament has the power to regulate the powers and structure of the Election Board. In this case, the powers of the Electoral Board can be restricted or its structure can be changed if the parties in the parliament secure a majority of votes. In addition, the electoral system could also be changed.

"WE THREW THE BALLOT PAPERS IN THE RUBBISH BIN"

On election day, one of the most talked about developments was the sealed ballot papers found in the rubbish bin at exit G-111. With the media coverage of this development, many parties, especially the MRP, reacted to the Election Board. Ipek Eren Vural responded to this question by saying, "According to the information I received, the votes in the rubbish bin have already been counted and thrown away by our friends. There is nothing to denigrate these democratic elections." 

Another person who knew who threw the ballot papers in the bin was a Notario reporter. Therefore, Notario was another focus of the reactions. Notario responded to these pressures by stating that they were not obliged to disclose their news sources in accordance with Article 12 of the Press Law no. 5187 dated 09.06.2004. It was also stated that Notario publishes by adhering to the principles of independent and transparent journalism and that no person or organization can be suspected of being a news source.

Press Law, Article 12: The owner of a periodical, the responsible manager and the author cannot be forced to disclose their sources of news, including information and documents, and to testify in this regard.

Seçimlerin hemen ardından Seçim Kurulu asil üyelerinden Assoc.Prof. İpek Eren VURAL Notario’ya konuştu. Vural, seçim süreci hakkında genel bir değerlendirmenin ardından gelen eleştirilere yanıt verdi.

“SEÇİME İLGİNİN YÜKSEK OLMASI MUTLULUK VERİCİ”

Seçime ilginin bu kadar yüksek seviyede olmasının demokrasi ve süreç için mutluluk verici olduğunu ifade eden Vural, tüm partileri de kutladı. Vural, sözlerine “Partiler medeni bir şekilde propagandalarını yaptılar, sonuçları olgunlukla karşıladılar.” ifadesiyle devam etti.

“KAPALI SAYIM KARARI PARTİLERE ATILMIŞ BİR YEMDİ”

Vural, kapalı sayım sorusuna “Kapalı sayım kararı, partilerin bir araya gelip itiraz etmelerini sağlamak amacıyla kasıtlı yapılmıştı. Partilerin ortak paydada buluşmasını sağlamak ve itiraz haklarını kullanmalarını amaçladık. Ancak partiler bu fırsatı değerlendiremedi.” ifadesiyle cevap verdi. Ayrıca, Seçim Kurulu’nun bu tarz partilerin aleyhine kararlar alabileceklerini ve partilerin buna itiraz hakkı olduğunu daha önce kendi dersinde duyurduğunu belirtti. Bu bağlamda, eğer bir partiden dahi itiraz olsaydı açık sayım yapılabilecekti. Meclise giren partilerin, aynı şekilde parlamentonun ilk oturumunda da bu tür kararlarla karşılaşabileceklerini ve bu durumlara hazır olmaları gerektiğini ifade etti.

Vural, ek olarak, parlementonun Seçim Kurulu’nun yetkilerini ve yapısını düzenleyebilecek bir gücü olduğunu belirtti. Bu durumda, Meclis’teki partilerin oy çokluğunu sağlaması halinde Seçim Kurulu yetkileri kısıtlanabilir veya yapısı değiştirilebilir. Bunun yanında, seçim sistemi de değiştirilebilir.

“ÇÖPTEN ÇIKAN OY PUSULALARINI BİZ ATTIK!”

Seçim günü, en çok konuşulan gelişmelerden biri G-111 çıkışındaki çöp kutusunda bulunan mühürlü oy pusulalarıydı. Bu gelişmenin basına yansımasıyla, MRP başta olmak üzere birçok partiden Seçim Kurulu’na tepkiler geldi. İpek Eren Vural, bu soruya “Bana gelen bilgiye göre çöpteki oylar zaten sayılmış ve bizim arkadaşlarımız tarafından çöpe atılmış. Ortada bu demokratik seçimleri karalayacak bir durum yok.” sözleriyle yanıt verdi.

Oy pusulalarını çöpe kimin attığını bilen bir başka kişi ise Notario muhabiriydi. Bu nedenle, tepkilerin bir başka odağı da Notario oldu. Notario bu baskılara, 09.06.2004 tarihli 5187 no’lu Basın Kanunu’nun 12.maddesi uyarınca haber kaynaklarını açıklamak zorunda olmadıklarını belirterek cevap verdi. Notario’nun bağımsız ve şeffaf habercilik ilkelerine sadık kalarak yayım yaptığı, hiçbir kişi ve kurumun yalnızca haber kaynağı olduğu gerekçesiyle zan altında bırakılamayacağı da belirtildi.
